Affidavit says Leawood assisted living employees shot at each other inside facility’s dining room

One man has been charged with attempted first-degree murder in the shooting, which occurred early on the morning of Feb. 10 at The Healthcare Resort of Leawood.

A probable cause affidavit details an exchange of gunfire that happened inside a Leawood assisted living facility earlier this month.

Leawood Police were called to The Healthcare Resort of Leawood at 5401 W. 143rd St., at 3:31 a.m. on Tuesday, Feb. 10, for a reported armed disturbance with shots fired.

The affidavit, released by Johnson County District Court in response to the Post’s request, says police received several 911 calls that morning reporting gunshots heard inside the facility near a nurse’s station.

“Officers arrived and contacted an employee of the facility [victim’s name redacted] who had his hands raised and indicated he was armed,” the affidavit says.

The victim told officers that he had been shot at by Darrick Miller, another employee at the facility, and fired one shot back at Miller.

Other witnesses told police that Miller ran from the building after the shots were fired.

Miller is now charged with attempted first-degree murder and remains in custody at the Johnson County Adult Detention Center in New Century.

Booking logs show Miller, 32, is from Kansas City, Missouri.

According to the affidavit, the victim told police that he and Miller had “exchanged words” related to a text thread between the victim and Miller’s girlfriend, who is also an employee at the facility.

Threats were made in the text thread, including Miller saying that he would be willing to “take it outside.”

Investigators look at security camera footage

Officers reviewed security footage that showed Miller using a keycard to get into the front door of the building, walking to the nurse’s station, pulling a gun from his pocket and then firing shots in the direction of the victim, before running back out of the building the same way he had entered.

The affidavit says the victim was sitting at a table in the dining area near the nurse’s station when the shots started.

“Investigators located at least five points of impact, in the wall and one through the window near the chair where [redacted victim’s name] had been seated,” the affidavit reads. “They also recovered multiple spent 9MM shell casings adjacent to the nurse’s station in the 4-way hallway intersection.”

The victim told police that he was sitting at a table near the east windows of the dining room when he heard two gunshots, at which point he jumped up and “scurried over to a wall close by that would protect him from Miller.”

The affidavit says the victim fired one shot back at Miller before the victim tried to escape the building but encountered a locked door. He instead found an empty room where he and two nurses hid.

Miller arrested in Overland Park

Police reviewed traffic camera footage from the intersection of 143rd Street and Nall Avenue, which showed the suspect running west across Nall. He was picked up a short time later by a Hyundai Sonata.

Overland Park Police located that car as it drove into an apartment complex. A woman walked away from the car as an Overland Park officer approached. Miller was still inside the car and was detained.

The affidavit says Miller was transferred to Leawood Police’s custody and refused to answer any questions.

Handgun located after search

Traffic camera video also led a K-9 team to the area in the woods where Miller allegedly tried to dump the gun before he was picked up by the car.

The K-9 team located a black-and-silver handgun in the tree line.

On Feb. 11, a day after the shooting, Miller was charged with one count of attempted first-degree murder.

He remains in the custody of the Johnson County Sheriff’s Office at the New Century Adult Detention Center on a $750,000 bond.

His next court appearance is scheduled for Thursday, March 26, at 2 p.m.
